1. These terms

These terms are the agreement between you and us for your use of Frequency Studio at abundantmoon.app/studio and in its apps (“Frequency Studio”, “the service”). By creating an account or subscribing, you agree to them. If you do not agree, please do not use the service. How we handle your information is set out in our Privacy Policy, which forms part of these terms.

2. The service

Frequency Studio plays Solfeggio tones and binaural beats with music for focus, meditation and rest. Every tone is free to play. A subscription opens the full Studio: the areas of life, all the waves, the mix and saved blends.

Frequency Studio is also part of Abundant Moon, and one account works in both. An Abundant Moon membership includes the full Studio. We may add, change or retire features, and what is free and what is part of a subscription may change. If a change materially reduces what a subscriber has already paid for, we will tell them by email beforehand.

3. Not a treatment

The service is music and tone for enjoyment, focus, meditation and rest. It is not medical or psychological treatment and makes no claim to treat, cure or prevent any condition. Do not listen while driving or operating machinery, or anywhere you need your full attention. If you have epilepsy, a heart condition, or are unsure whether listening is right for you, ask a qualified professional first. Keep the volume at a comfortable level.

4. Who can use it

You must be 18 or older. One account is for one person; please keep your sign-in email secure and tell us if you think someone else has used your account.

5. Subscriptions, prices and billing

Plans. The full Studio is sold monthly ($7 a month) or annually ($49 a year) on the web. The price is shown before you pay. Prices in the iPhone app are set in the App Store and shown there.
Automatic renewal. A subscription renews automatically at the end of each month or year, and your payment method is charged for the next month or year until you cancel.
Free trials. Where a free trial is offered (for example in the iPhone app), you are charged when it ends unless you cancel before then.
Currency and tax. Web prices are in US dollars and are the full amount we charge; we do not add tax at checkout. Your bank or card provider may charge its own currency conversion or international fee.
Codes. Promotional codes are personal to the person we give them to, cannot be exchanged for money, and may be withdrawn if misused.
Price changes. If we change the price of your subscription, we will email you at least 30 days before the change applies to your next renewal, and you may cancel before then.
Payment. Web payments are processed by Stripe; we do not see or store your card details. Payments in the iPhone app are processed by Apple under Apple’s terms. If a payment fails we may try again, and the full Studio may pause until it succeeds.
Abundant Moon members. If you join Abundant Moon while you hold a Frequency Studio subscription, your Studio subscription ends at the close of the period you have paid for, so you are not charged for both.

6. Cancelling and refunds

You can cancel a web subscription at any time from your account, or by writing to auriana@abundantmoon.app. A subscription bought in the iPhone app is cancelled in your iPhone’s Settings. Cancelling stops the next renewal; the full Studio stays open to the end of the period you have paid for.

We do not refund part-used periods or give refunds for a change of mind, except where the law requires it. If you think you have been charged in error, write to us within 30 days and we will put it right. Refunds for purchases in the iPhone app are handled by Apple.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits your rights under that law, including your right to a remedy if the service has a major failure.

7. Using the service properly

Please do not use the service for anything unlawful or harmful; try to break, overload, probe or reverse-engineer it; record, download or redistribute its sound at scale; share, resell or sublicense your account; or use it to build a competing product.

8. Our content

The service, including its sound, music, design, figures and text, and the names Frequency Studio and Solfeggio Delta Waves, belongs to us or our licensors. Your subscription lets you listen for your own personal use.

9. Suspension and ending

We may suspend or close an account that breaks these terms or puts the service or other people at risk. If we close a paid account for any reason other than a breach of these terms, we will refund the unused part of the period paid for. You may stop using the service and delete your account at any time from your account page.

10. Availability and liability

We work to keep the service available, but it is provided as it is and may be interrupted. We use other companies’ services to run it and are not responsible for their outages. To the extent the law allows, our liability for any failure of the service is limited to supplying the service again or refunding what you paid for the affected period, and we are not liable for indirect or consequential loss. This does not limit any right or remedy that cannot be limited by law.

11. Changes to these terms

We may update these terms. The date at the top shows the latest version. We will email you about material changes before they take effect; continuing to use the service after that means you accept them.

12. Governing law

These terms are governed by the laws in force in Australia, and you and we submit to the non-exclusive jurisdiction of the Australian courts. If you live elsewhere, you keep any consumer protections your own country’s law gives you that cannot be waived.
